Terms of Service

Please read these terms carefully before using the Postject platform.

1. Acceptance of Terms

By accessing or using the Postject platform, API, dashboard, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Postject provides email infrastructure services, including but not limited to: • A RESTful API for sending transactional and promotional emails • A web-based dashboard for managing servers, message streams, templates, and analytics • Domain verification and identity management tools • Webhook delivery for email event notifications • Team collaboration and access management features We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for: • Maintaining the confidentiality of your account credentials and API keys • All activity that occurs under your account • Notifying us immediately of any unauthorized access or security breach You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use Policy

You agree not to use the Service to: • Send unsolicited bulk email (spam) or messages that violate CAN-SPAM, CASL, GDPR, or any applicable anti-spam legislation • Transmit malware, phishing attempts, or any malicious content • Impersonate another person or entity • Harvest or collect email addresses without consent • Send emails to purchased, rented, or scraped mailing lists • Interfere with or disrupt the Service or its infrastructure • Exceed your plan's rate limits through automated circumvention • Use the Service for any illegal purpose We enforce progressive rate limiting for new accounts and reserve the right to suspend accounts that exhibit suspicious sending patterns, high bounce rates, or spam complaints.

5. Pricing, Billing & Payments

Postject offers both free and paid plans. By subscribing to a paid plan, you agree to: • Pay all applicable fees as described at the time of purchase • Authorize recurring charges based on your billing cycle • Accept that plan features and quotas are subject to change with prior notice Overage charges apply when you exceed your monthly email quota. Current overage rates are listed on our pricing page and may be updated with 30 days' notice. All fees are non-refundable except where required by applicable law. We reserve the right to change pricing with reasonable advance notice.

6. API Usage

Your use of the Postject API is subject to the following: • API keys are unique to your account and must not be shared or exposed publicly • You are responsible for securing your API keys. Compromised keys should be regenerated immediately • We reserve the right to rate-limit or throttle API requests to protect platform stability • API responses and error messages are provided for diagnostic purposes and should not be displayed directly to end users

7. Data & Privacy

We take data privacy seriously. Our handling of your data is governed by our Privacy Policy. Key points: • We process email content solely for the purpose of delivering your messages • We do not sell, share, or monetize your data or your recipients' data • Email content is retained for a limited time for delivery, debugging, and analytics, then purged • You are responsible for ensuring you have proper consent to email your recipients • We comply with GDPR and other applicable data protection regulations

8. Intellectual Property

The Service, including its design, code, documentation, and branding, is owned by Postject Inc. and protected by intellectual property laws. You retain ownership of any content you send through the Service. By using the Service, you grant Postject a limited, non-exclusive license to process your content solely for the purpose of providing the Service.

9. Service Level & Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for: • Scheduled maintenance windows (announced in advance when possible) • Outages caused by third-party providers, including cloud infrastructure and email delivery partners • Force majeure events beyond our reasonable control Our current target uptime is 99.9% measured on a monthly basis.

10. Limitation of Liability

To the maximum extent permitted by law, Postject Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Our total liability for any claims under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

Either party may terminate this agreement at any time: • You may close your account at any time through the dashboard or by contacting support • We may suspend or terminate your access if you violate these Terms, engage in abusive sending practices, or pose a risk to platform integrity Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the dashboard at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of Delaware, at our discretion.
